Aviation Litigation
- Dawn Shelton Sayre, Executrix v. Aimee Kraaijvanger,
Executrix.,, (Suffolk Superior Court). I
represented the estate of a pilot killed by a mid-air collision
at an air show. The case settled without trial.
- Sylvia Press, Executrix v. David Rothstein, Executor,
et al.,, (Middlesex Superior Court). I represented
the estate of a man killed in an air crash in Crooked Island,
Bahamas. The case settled without trial.
- Kenneth Sherman v. Robert Lebewohl, (Worcester
Superior Court). I represented a man who severely injured
by a mid-air collision. The case settled without trial.
- Avis L. Crane, Administratrix v. Jeffrey Walcott, et
al,, Middlesex Superior Court. I represented a man
burned over 86% of his body after a crash that occured during
flight instruction. The case settled without trial.
- Laurent Frutin v. Aviation East, Inc. et al.,,
(Suffolk Superior Court). I represented the Defendant in an
action brought against it by the plaintiff, who had lost a leg in
a mid-air collision. The case settled without trial.
- Joao Jose Freitas, et al. v. Aircraft Equipment
Company, et al. v. United States of America,
(Federal District Court). I represented the Defendant FBO
agianst claims against it for negligent entrustment of an
aircraft after three people died in a plane crash. The case
was tried which resulted in a defense verdict for my client.
- Maude Robinson, et al. v. Flight Center, Inc., et
al., (Essex Superior Court). I represented the
defendant FBO (renter of the aircraft) in an action brought by
the estates of three persons, who died in a crash. The case
settled without trial.
- Daniel Leal v. King Services of Aviation, Inc. et
al., )Bristol Superior Court). I represented
the Defendant FBO, and it's instructor when a student sued
for severe personal injuries. The case was settled.
- Lynne M. O’Riorden v. Vector Aircraft Corp. et
al., (Middlesex Superior Court). The estate
of a man killed in a plane crash sued for wrongful death. I
represented the defendant owner of the aircraft. The case
settled.
- N.R.A.A.. Inc., James Orme, Robert Feuersanger and
Alfred Feuerdanger v. Windham Aircraft, Inc., Windham Aircraft
Engines, Inc., City Engines, Inc. and Consolidated Fuel Systems,
Inc., Middlesex Superior Court. I represented
one of the defendants in a negligence action. The case was
settled.
- Thomas Sullivan v. Beverly Flight Center,
Inc., I represented the Defendant FBO in a
claim brought against it. The case was settled.
- Tremalle Clarke v. Mass. Port Authority and U.S.
Air, Suffolk Superior Court. I represented the
plaintiff in a claim against the defendants. The case
settled.

Scuba Diving
- Maddonna Licata, Administratrix v. P.A.D.I., et
al., (United States District Court, Ninth
Circuit). While on his honeymoon the plaintiff died during
an introductory scuba course. The case was settled and is
subject to a nondisclosure agreement.
- Carol Borden, Executrix v. P.A.D.I. et
al., (Circuit Court of the First Judicial Circuit,
Okaloosa County, Florida). I represented someone who died
during a scuba diving excursion. Although Summary Judgment
was sustained on appeal because decedent signed a release prior
to the dive, the appellate court decision was divided.

Product Liability Cases
- Robert E. Dickson v. The Rawlplug Company, et
al.,(Suffolk Superior Court). The plaintiff was
seriously injured when a ceiling collapsed. I represented
the manufacturer of the “plugs” that were shot into
the cement roof that anchored the ceiling. I settled
the case prior to trial. The case continued against other
defendants. The Plaintiff won over 2.2 million dollars in the
final verdict.
- Ashley Nawn, et al. v. Water Heaters Only, Inc., et
al., (Middlesex Superior Court). Three
children were burned over 90 percent of their bodies when a fire
broke out in the garage of their home. My client was
released from the claim without contribution to settlement.
- John McGlashing v. Lewis/Boyle,
et
al., (Middlesex Superior Court).
The Plaintiff alleged that a forklift truck that he
was operating was improperly serviced and otherwise
defective. The forklift slid into a rack causing
the collapse of the rack's contents onto the Plaintiff
causing severe injuries. I represented the
Defendant Lewis/Boyle against Product Liability and
Negligence claims. There was a Jury Verdict in
favor of my client after a four-day trial
- Richard W. Keenan v. Robert G. McCormick v.
Baker Golf Cars, et al., (Norfolk Superior
Court). The plaintiff was injured while driving
a golf cart. I represented the manufacturer of
the golf cart. The case settled without trial.
- Florence Kossover v. United Prosthetics,
Inc., (Essex Superior Court). I
represented the Defendant manufacturer of a prosthetic
device in a case brought against it for the failure of
that device. The case settled.
- Donald Rideout v. First Medical,
Inc., (Suffolk Superior Court). I
represented the Defendant manufacturer of a prosthetic
device in a case brought against it for the failure of
that device. The case settled.
- Michelin Tire Corp. v. NRG Barriers, Inc.,
et al., (Federal District Court, First
Circuit). The Plaintiff alleged that the roofing
materials supplied by my client were defective.
The case settled.
- Ann Keaney, Executrix v. North Star Ice
Equipment Corp., et al., (Suffolk Superior
Court). The plaintiff was the wife of a man who
was killed when he entered a high-capacity icemaker on
the Boston Harbor Docks. I represented the
Defendant manufacturer. The case settled.
- Richard Miller and Debra Miller v. Electro
Switch Corporation, et al., (Suffolk
Superior Court). I represented the Defendant
manufacturer of a switch assembly that was part of a
crane. The plaintiff was severely injured when
the crane made an uncommanded operation. The
case settled.
- Kevin O’Toole, et al. v. Michigan Hanger
Co., Inc., et al., (Norfork Superior
Court). I represented a defendant in a product
liability action. The case was settled.
- Marilyn Donalda McCue, et al. v. First
Medical v. Becker Orthopedic Appliance Company, et
al., (Norfolk Superior Court). I
represented the Defendant manufacturer of an
orthopedic brace that allegedly failed. The case
settled.
- Katherine Dudley v. West Lynn
Creamery, (Essex Superior Court). The
Plaintiff alleged that she drank “tainted” milk and
suffered panic attacks shortly after ingestion.
I represented the Defendant West Lynn Creamery against
Product Liability, Negligence and 93(A) claims brought
against it. There was a Verdict in favor of my
client after a seven-day jury trial.
- Richard W. Keenan v. Baker Golf Cars, et
al., (Norfolk Superior Court). I
represented the Defendant manufacturer in a claim for
the negligent design and maintenance of their golf
cart. The case settled.
- Patricia Fenn v.
Supreme Equipment & Systems Corp., (Suffolk Superior
Court). The Plaintiff alleged that a defect in the
manufacture and/or assembly of a file cabinet system caused it to
fall on top of her. I represented the Defendant Supreme
Equipment & Systems Corp. against Product Liability and
Negligence claims brought against it. There was a Verdict in
favor of my client after a three-day jury trial
- Thomas Westland v. The Home Depot and Gainsborough
Hardware Industries, (Norfork Superior
Court). I represented the Defendant manufacturer and
distributor. The case settled.
- Lindomar Tolomeau v. Opus, Inc., et al.,
(Norfolk Superior Court). The plaintiff lost his hand while
working on a punch press. I represented the defendant. The
case settled.
- John J. Bertelli v. Lewis/Boyle,
et
al., (Middlesex Superior Court).
The Plaintiff alleged that forklift truck that he was

defective. I represented the Defendant
Lewis/Boyle against Product Liability and Negligence
claims. The case settled after three-day jury
trial
- Samuel B. Goldman v. Lennox Industries,
Inc., (Norfolk Superior Court). I
represented the Plaintiff, who suffered a heart attack
induced by carbon monoxide poisoning from gas that
originated from a poorly maintained gas fired
furnace. Suit was brought against both the
condominium association and the manufacturer of the
gas-fired furnace. Verdict was for my client
against the condominium association after a five-day
jury trial

Negligence Actions
- Ermes Cametti v. Boston Redevelopment Authority, et
al., (Suffolk Superior Court). I represented the
Plaintiff, a Boston Police Officer. While on patrol his
police cruiser struck a protruding manhole cover. Mr.
Cametti was partially paralyzed as a result. The case
settled after extensive trial preparation.
- David Leary, Executor of the Estate of Walter P. Chase
v. GMK Realty Trust, et al., (Essex Superior
Court). I represented the Plaintiff, who suffered from the
effects of long term carbon monoxide poisoning from gas that
originated from a poorly maintained gas-fired furnace located in
his bedroom. Suit was brought against the landlord.
The case settled without trial.
- John J. Bertelli v. Lewis/Boyle, et al.,
(Middlesex Superior Court). The Plaintiff alleged that a
forklift truck he was operating was improperly serviced and
otherwise defective. I represented the Defendant
Lewis/Boyle against Product Liability and Negligence
claims. The case settled after three-day jury trial
- Robert Marques v. Restaurant Consultants, Inc.,
(Middlesex Superior Court). I represented the plaintiff,
who was struck by a drunk driver who had been drinking in the
defendant’s establishment. The case settled.
- James J. Vey, et al. v. Gunning Metals, et al.,
(Norfolk District Court). The Plaintiff was injured
while working on a construction site. I represented the
Defendant, Gunning Metals, against Construction Accident
Liability and Negligence claims brought against it. Defense
verdict agter a two-day trial.

Inc. et al.,, (Norfolk Superior Court). I
represented the defendant in an action brought against it by the
plaintiff. The case settled without trial.
- Paul H. Gross v. Epoxy Technology, Inc., et
al., (Middlesex Superior Court). I
represented the Defendant in a negligence case. The case
settled.
- Alice Fitzgerald v. C.N. Wood Co. Inc., et
al.,, (Middlesex Superior Court). I represented the
defendant in an action brought against it by the plaintiff.

- Thomas Talbot v. United States of America v. Needle
Industries (USA), Inc. v. Shrimpton and Fletcher,
(United States District Court, First Circuit). I
represented the Defendant Needle Industries. The case settled.
- Barbara Turpin v. RBW Enterprises, Inc.,
(Middlesex Superior Court). I represented the Defendant in
a claim brought against it. The case settled.
- James J. Vey, ppa v. Gunning Metals, et
al., (Norfolk Superior Court). I represented
the Defendant in a claim brought against it by the plaintiff. The
case was settled.

represented the Defendant. The case settled.

Construction Accidents

Premises Liability Cases
- Samantha Hoy, et al. v. Hughes Century 21, et
al., (Essex Superior Court). I represented the
Plaintiffs. The father was carrying his daughter when the
railing on the porch gave way. The case settled.
- Lawrence Linehan v. Beaumont Realty Trust. et
al., (Middlesex Superior Court). I
represented the defendant owner of property in a negligence
action. The case settled.
- Arthur Garland v. Hi-Mar Realty Trust, et al.,
(Norfolk Superior Court). I represented the Plaintiff, who
fell on a sheet of ice on the defendant’s property.

- Charles DeAngelo v. ElJohnan, Inc.,
(Charlestown District Court). I represented the Defendant
owner of an office building leased to the Post Office. The
Plaintiff alleged that he had sustained serious injuries as a
result of a slip and fall. The case settled after one day
of trial.

represented the Defendant owner against a slip and fall
claim. The case settled.
- Leslie McAdams v. Harvard University,
(Middlesex Superior Court). I represented the plaintiff,
who injured her back when she slipped and fell while on her way
to class. The case went to binding arbitration and resulted
in a substantial verdict for the plaintiff.

Superior Court). I represented the plaintiff who was shot
during a party at the hotel. The case settled.

al., (Middlesex Superior Court). I
represented the Defendant property management company in a
negligence claim brought. The case settled.
- Alice and James Angell v. The Greek Orthodox
Church, (Suffolk Superior Court). I represented the
church in a slip and fall claim. The case settled.
- Coburn v. Cliftondale United Methodist Church,
(Lynn District Court). I represented the Church in a claim
brought by the plaintiff for injuries sustained as the result of
a slip and fall. The case settled.
- Robert and Diane Dorr v. R.M. Bradley, et
al., (Suffolk Superior Court). I represented
the Defendant, R.M. Bradley, against negligence claims. The
case settled.
- Sara Hull v. Alan Lawrence Realty Trust, et
al., (Norfolk Superior Court). I represented
the Defendant. The case settled.
- Esther and William Howard v. Essexbank,
(Essex Superior Court). I represented the Defendant bank
after the Plaintiff injured herself in a fall on the
premises. The case settled.

represented the Defendant franchise operator. The case

Superior Court). I represented the Defendant owner.

- Walter and Ann Bennett v. Purity Supreme, Inc.,
(Middlesex Superior Court). I represented the Defendant
Purity Supreme in a claim for injuries sustained as a result of a
slip and fall. The case settled.
- Robert L. Graves v. West Lynn Creamery Realty
Corporation, (Suffolk Superior Court). I
represented the Defendant in an action brought against it by the
plaintiff. The case settled without trial.
- Helen and Edward Gill v. Handbags and Luggage, Ltd., et
al., (Norfolk Superior Court). I represented
the Defendant in a suit filed against it. The case settled
without trial.
- Debra Recore, ppa. v. Newton Buying Corp. Clean Machine
Enterprises, et al. v. All Seasons Services
Company, (Worcester Superior Court). I
represented the Defendant owner in a slip and fall claim.

(Middlesex Superior Court). I represented the Defendant CRC
Realty Company in a slip and fall. The case settled.
- Killian and Frances Brady v. Adrian’s Fabrics and
Decorating, et al., (Middlesex Superior Court). I
represented the Defendant in a claim brought by the plaintiff for
injuries sustained as a result of a slip and fall. The case
settled.

Sexual Assault and Battery
- (Name Withheld) v. Charter Behavioral Health of
Massachusetts, et al., (Suffolk Superior
Court). I represented a minor who was raped while being
treated at an in-patient facility. The case settled.
- (Name Withheld) v. Gilbert/Robinson, Inc. d/b/a
Houlihan’s, et al., (Suffolk Superior
Court). I represented a minor female who was admitted to
the defendant’s bar. She met four boys (3 of whom
were also minors) who offered her a ride back to Harvard
University where she was a student. Instead, they took her
to a remote area where they gang raped her. The case
settled.
- I have also represented priests/pastors and their churches
for alleged instances of child abuse.

Intellectual Property
- Marion Roth v. Harper Collins Publishers, et
al., (United States District Court, First
Circuit). I represented the plaintiff photographer whose
works were copied by an illustrator for publication. The
case settled.
